Legal Agreements

There may be instances where a condition of subdivision and/or rezoning approval will be that the land owner/developer enter into, execute and deliver a legal agreement with the City of Winnipeg. These legal agreements are registered on the land's Status of Title by caveat.

Some examples of possible legal agreements include:

  • Development Agreement - A Development Agreement is required as a condition of approval for a subdivision and rezoning application for the installation of municipal services and plan considerations and which can be registered by way of caveat on the title of the property it affects. A public hearing is not required for an amendment to a Development Agreement, however, the amending application is subject to review by all committees of Council with final approval required by Council.

  • Servicing Agreement - A Servicing Agreement is required as a condition of approval for a subdivision and/or rezoning application to facilitate the extension and installation or upgrade of existing municipal services and plan considerations and which can be registered by way of caveat on the title of the property it affects. A public hearing is not required for an amendment to a Servicing Agreement, however, the amending application is subject to review by all committees of Council with final approval required by Council.

  • Zoning Agreement - A Zoning Agreement may impose additional approvals and/or restrictions and can be registered by way of caveat on the title of the property it affects. The public hearing process is required for an amendment to a Zoning agreement and Council approval is also required.

  • Subdivision Agreement - A Subdivision Agreement is required as a condition of approval for a short form subdivision application for various reasons, such as plan considerations for future development, or imposing restrictions on development which can be registered by way of caveat on the title of the property it affects. A public hearing is not required for an amendment to a Subdivision Agreement, however, the amending application is subject to review by all committees of Council with final approval required by Council.

  • Sales & Purchase Agreement - An Agreement for the sale or purchase of City-owned land.

  • Easement Agreement - An Agreement that enables rights given to the City of Winnipeg to trespass upon or use land owned by somebody else for the purpose of maintenance and/or installation of utilities and/or services such as water, sewer, land drainage, utilities, snow storage, pathways etc. A property owner cannot build on top of or over an easement defined area.

*Additional fees shall be applied to the Development Application for the processing of agreements as deemed necessary.
