Is a permit required?
Yes, a development permit may be required.
Outdoor pools, hot tubs/spas and any other structure capable of containing 600 mm (2’0”) or more of water do not require a development permit. They must comply with zoning regulations for property line setbacks. A development permit is required if the structure is located next to a storm water retention basin or is in the Designated Floodway Fringe Area. Zoning and development permit approval must be obtained before building permit application.
Yes, a building permit is required.
All outdoor pools, hot tubs/spas and any other structure capable of containing 600 mm (2’-0”) or more of water requires a building permit as per the Winnipeg Building By-law.

Before applying for a building permit:
- ensure you have obtained prerequisite zoning and development permit approval, if required
Note: New outdoor pools and hot tubs/spas in new greenfield subdivisions with prior development agreements on title do not require prerequisite development permit approval if submitted at the same time as the new home application. In this case, your development permit will be processed as part of your combined development/building permit application.
